1. THIS AGREEMENT

1.1 By purchasing, using, or accepting the Game Credits or the Game Card, you agree to be bound by this Agreement between yourself and Proxima Beta Pte. Limited (“us” “we”, “our”). If you do not agree to this Agreement, please do not purchase, use or accept the Game Credits. 

1.2 We may make changes to this Agreement at any time, so please come back and review them.  You will be deemed to be aware of and to be bound by any changes to this Agreement upon publication of such changes on this site.

1.3 As contemplated by the PUBG Mobile End User Licence Agreement (the “PUBG Mobile EULA”), including its “Virtual Goods and Virtual Currency” section :

(a) this Agreement is deemed to form part of, and is subject to, the PUBG Mobile EULA (including the PUBG Mobile Privacy Policy);

(b) the Game Credits are “Licensed Items” for the purposes of the PUBG Mobile Terms; and

(c) to the extent there is any inconsistency or conflict between this Agreement and the PUBG EULA, the former will prevail to the extent of any such inconsistency or conflict.

2. VALIDITY AND REDEMPTION

2.1 You may redeem your Game Credits on the PUBG Mobile redemption page at https://www.midasbuy.com/id/rc/pubgm  (the “Redemption Page”) which is hosted by Midasbuy, a third-party provider. Your use of the Redemption Page is subject both to this Agreement and to Midasbuy’s terms and conditions, including their Terms of Use.   We are not responsible for your use of Midasbuy or any other third-party platforms in relation to PUBG Mobile.

2.2 Your Game Credits are valid until the expiry date as set out on the receipt of your purchase of the Game Card.  Game Credits that have not been used for 12 consecutive months after redemption will expire (if their expiry date has not been reached before then).

2.3 If you have obtained your Game Credits on a Game Credit Card, your Game Credits cannot be partially redeemed – all Game Credits on the Game Credit Card must be redeemed at the same time.

2.4 The Game Card is single-use only.  Once all Game Credits have been redeemed from the Game Card, the Game Card cannot be used again.

3. REFUNDS AND EXCHANGE

3.1 As contemplated under the “Payments, Fees and Charges” section of the PUBG Mobile EULA, you agree that:

(a) any payments you make to us for your use of the Game Credit Cards and Game Credits are final and non-refundable; and

(b) SUBJECT TO MANDATORY APPLICABLE LAWS AND REGULATIONS, IN NO CIRCUMSTANCES WILL WE BE REQUIRED TO PROVIDE A REFUND FOR ANY PAYMENTS MADE BY YOU TO US IN RELATION TO ANY GAME CREDIT CARDS OR GAME CREDITS (WHETHER USED OR UNUSED).

3.2 You are responsible for your Game Credit Cards and Game Credits. Any Game Credit Cards or Game Credits that are lost or stolen will not be replaced by us.

4. PURCHASE AND USE OF THE GAME CREDITS

4.1 Game Credit Cards may only be purchased from our authorized distributors.

4.2 The Game Credits may be used solely for the purposes of playing PUBG Mobile. You do not own the Game Credits. 6.2 In no event will we be liable to you or any third party, in contract, tort (including negligence), or otherwise, for any indirect or consequential loss, expense, or damage of any kind.

7. GENERAL

8. GOVERNING LAW

8.1 This Agreement shall be governed by the laws of Hong Kong. Any dispute, controversy, or claim (whether in contract, tort, or otherwise) arising out of, relating to, or in connection with this Agreement, including their existence, validity, interpretation, performance, breach, or termination, will be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre under the Hong Kong International Arbitration Centre Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of the arbitration will be in Hong Kong. There will be one arbitrator only. The arbitration proceedings will be conducted in English.
